FIQH
(ISLAMIC JURISPRUDENCE)
The person who is in the habit of waking up for Tahajjud Salaah in the latter
part of the night and has full confidence of definitely waking up; then it
is better for him to offer his Witr Salaah after having offered his Tahajjud
Salaah. But if he is not confident of waking up and fears that he will remain
asleep; then he should offer his Witr Salaah after his Esha Salaah before
going to sleep.
THE
MESSAGE
Khutbah - Conditions for Victory, Reasons for Defeat
By Sh Waleed Al-Mineesi – Imam of Haram
----------------------------------------------
The companion Abdullah Ibn Abbas RA narrated that the Prophet sallallaahu
‘alaihi wa sallam said: “Five matters result when five things
happen: If people break their covenant with Allah, He will send an enemy against
them; If they rule by other than the Law of Allah, poverty will spread among
them; If they become deceptive in trade, Allah will deprive them of crops
and they will be struck with famine; And if they withhold the payment of Zakah,
they will be struck with drought.” (Tabaraani). In another narration
he sallallaahu ‘alaihi wa sallam said: “If they break the covenant
of Allah and His Messenger, Allah will send an external enemy against them
who will seize some of their possessions; If they do not rule by the Book
of Allah, nor attempt to implement everything in it, Allah will spread enmity
among them.”
This is a comprehensive clarification of the conditions for victory and the
causes of defeat for the Muslim nation. Breaking the covenant of Allah and
His messenger, or in other words, disobeying Allah and His messenger, is one
of the reasons for its defeat and being subjugated by its enemies. Likewise,
ruling by other than the rulings of Allah is the reason for the poverty, disunity
and conflict which is occurring among the Muslims.
Conversely, obeying Allah and His Messenger sallallaahu ‘alaihi wa sallam
is the source of victory. Allah says that which translates as: “O you
who have believed, if you support Allah, He will support you [by giving you
victory].” (Muhammad: 7).
Sa’d Ibn Abi Waqqaas RA was checking on his army during the battle of
Qaadisiyyah. He passed by the tent of one group of soldiers at night and found
the men inside praying Qiyaam, or voluntary night-prayer, and remarked: ‘Victory
comes from such a tent’ then he passed by another tent and found the
men inside sleeping and remarked: ‘Defeat comes from such a tent.’
This was despite the fact that the men who were sleeping only missed a recommended
prayer and not an obligatory one; yet Sa’d considered missing this recommended
act to be a reason for defeat.
Qutaybah Ibn Muslim, who was a great Muslim conqueror, was the leader of Khurasaan
when it was being attacked. He passed by Muhammad Ibn Waasi’, who was
one of the Taabi’een, or the generation that followed the Sahaba, while
Muhammad had his finger raised towards the heavens supplicating to Allah.
Thereupon Qutaybah remarked: ‘That finger is dearer to me than thirty
thousand soldiers’.
How can the Muslims expect Allah to grant them victory while they are discarding
prayers, refusing to pay Zakah and dealing in interest? What can they expect
when alcoholic drinks and nightclubs become prevalent in their lands? What
happens when evil becomes widespread?
Therefore, if we truly wish for victory, then we must change what is in ourselves
as Allah says that which translates as: “…Indeed Allah will not
change the condition of a people until they change what is in themselves …”
(Ar-Ra’d: 11).

This 80 year old woman was arrested for shop lifting. When she went before
the judge he asked her, "What did you steal?" She replied, "A
can of peaches."
The
judge then asked her why she had stolen the can of peaches and she replied
that she was hungry.
The judge then asked her how many peaches were in the can.
She replied, "6."
The judge said, "Then I will give you 6 days in jail."
Before the judge could actually pronounce the punishment, the woman's husband spoke up and asked the judge if he could say something. The judge said, "What is it?"
The husband said, "She also stole a can of peas."

Khalid
Rashid’s lawyer, Zahir Omar, says Safety and Security Minister Charles
Nqakula may know where the deported Pakistani is. Omar yesterday asked a full
bench of the Pretoria High Court to allow him to place "new information"
before them. He says he has received a "shocking" document compiled
by Amnesty International that suggests that Nqakula knew more about Rashid's
whereabouts. Presiding Judge Bernard Ngoepe asked Omar about a radio interview
he had given earlier in the morning. He warned Omar not to give the impression
that he was using the case to seek publicity.
The document contains minutes of the November 2006 meeting of the United Nations' Committee against Torture held in Geneva. It quotes Nqakula as saying that Rashid was visited in Pakistan, by officials from his department. Omar wants to know who visited Rashid and when they did so. He also wants to know why nobody wants to say where Rashid is. Advocate for the department of home affairs Mike Bofilatos, described the last-minute application as "nothing short of bizarre" and an abuse of the process of court. Omar says if someone can say where Rashid is and if his mother can see him then the case can end. Judgment in the application will be delivered today.
The Hamas-led Palestinian government has resigned. President, Mahmoud Abbas, has asked prime minister, Ismail Haniya, to form a new unity administration. The move comes after negotiations last week in Makkah Mukarramah. Haniya has five weeks to put together the new cabinet and get it approved by parliament, which is dominated by Hamas.
Schabir Shaik was yesterday ordered to go back to jail after spending 83 days in hospital. Correctional Services Minister Ngconde Balfour ordered that Shaik be removed from St Augustine's Hospital and sent to Durban-Westville Prison. Shaik was treated for high blood pressure. Medical tests by prison authorities followed recent media reports questioning Shaik's stay in hospital. Balfour says he had made the decision after viewing the reports of two private doctors. Shaik's brother, Mo, says Schabir is suffering from persistent high blood pressure that may be genetic and is drug resistant."
The Ghairoenisa Ghanchi murder case continued in the Johannesburg High Court yesterday. Ronald Jones, accused of raping and murdering 6 year old Ghanchi in October 2005 in Eldorado Park, says he was tortured by police to confess. Police officers and doctors have all told the court that he admitted to the crime, Jones says he was arrested by three police officers in December 2005. He named them as Inspectors Michael Grobelaar, Ramouthan and Pillay. The accused alleges that the he was assaulted by the police officers after denying that he new anything about Ghairoenisa. The trial contiues.
